D. Unlimited Data Directive/Bandwidth Use Directive/Data Compensation Directive. Unlimited data service plans are subject to the Unlimited Data Directive and, as outlined in Appendix A, if you use more than the data usage threshold in your service plan during your monthly billing period, we may prioritize your data behind other customers during network congestion, resulting in slower speeds. The Exede Classic, Essential 10, Evolution and WildBlue Internet Service plans are subject to strict data usage restrictions described in the Data Allocation Policy. If you exceed your data usage limits, Viasat will slow down and/or significantly limit your Internet service or certain uses of your Internet service for the remainder of your monthly billing period. Liberty service plans («Liberty Plans») are subject to the restrictions on the use of «priority data», which are also described in the Data Quota Directive. If you exceed your priority data usage limits, you will receive the «Liberty Pass» for the remainder of your monthly billing period. Liberty pass speeds are slower than priority data speeds, do not support video streaming across multiple devices, and may not support streaming high-definition video. Liberty Pass speeds vary depending on the time of day and geographic location and can be extremely slow when the network is saturated, typically in the evening (around 5:00 am.m — 2:00 am.m local time), which can strongly affect your ability to use the Internet. Liberty Pass users receive lower priority on our network than subscribers who have not exceeded their data volume or any other data threshold, which can lead Liberty Pass users to experience slower speeds when the network is saturated than subscribers who have not exceeded their data volume or any other data threshold. Heavier Liberty Pass users may be slower than lighter users. The Freedom Plan is subject to the Bandwidth Usage Directive and is not subject to any strict data compensation; However, if you use more than 150 GB of data during your monthly billing period, as shown in Appendix A, some speeds of your Internet service are slowed down, as described in the bandwidth usage policy.
